These Terms of Service (“Terms”) are an agreement between you and contXtual (“contXtual”, “we”, “us”) and govern your access to and use of the reTHINK marketing website at getrethink.com and the reTHINK spatial collaboration application at create.getrethink.com (together, the “Service”).

By creating an account, starting a trial, purchasing a plan or using the Service in any way, you agree to these Terms. If you are entering into this agreement on behalf of a company or team, you confirm that you have authority to bind that organisation.

• You must provide an accurate email address and keep your account details up to date.
• You are responsible for keeping your password and sign-in methods secure, and for all activity that happens under your account.
• You must be at least 16 years old to create an account.
• Tell us promptly at our support page if you believe your account has been compromised.

• Free trial: a 14-day trial with no credit card required. One trial per person or organisation unless we agree otherwise in writing.
• Pro and Business are paid monthly or annual subscriptions. Prices are shown on our pricing page before you confirm a purchase, and the annual option is billed once per year.
• Subscriptions renew automatically at the end of each billing period until cancelled.
• If you cancel, your plan remains active until the end of the current billing period and does not renew after that.
• Payments are handled by our payment provider acting as seller of record, which also handles sales tax, invoices and refunds. Card details are never stored by us.
• Upgrades take effect immediately; downgrades take effect at the start of your next billing period.

Each plan includes limits on the number of spaces, the number of guests per session, and features such as custom branding and team organisation tools. The current limits for each plan are published on our pricing page. If you exceed your plan's limits, we may ask you to upgrade or reduce usage; we will not delete your content without notice.

You agree not to misuse the Service. In particular, you will not:

• Use the Service for unlawful, harmful, fraudulent, harassing or infringing purposes or content.
• Attempt to access other users' accounts, spaces or data, or probe or scan the Service's security.
• Reverse engineer the Service except where that is not permitted by applicable law, or resell or redistribute access to the Service without our written permission.
• Place excessive load on the Service or interfere with other users' sessions.

You keep ownership of the documents, images, notes and other material you place inside reTHINK spaces (“Your Content”). You give us the limited permission needed to store, synchronise and display Your Content in order to run the Service for you and the people you invite.

You are responsible for having the rights to the content you add, and for sharing it appropriately with guests in your spaces.

We work to keep the Service available and improve it continuously, but we do not promise uninterrupted or error-free operation. We may make changes, add or remove features, and perform maintenance. Paid plans include support through our support page.

We may suspend or terminate an account if it seriously or repeatedly breaches these Terms, if required by law, or to protect other users and the Service. Where practical, we will give you notice and a chance to resolve the issue.

You can stop using the Service and cancel your plan at any time from your account settings. On termination, we keep Your Content for a limited wind-down period so you can recover it, after which it is deleted or anonymised.

Except as stated in these Terms, the Service is provided “as is” without warranties of any kind, whether express or implied, including fitness for a particular purpose. We do not warrant that the Service will be uninterrupted, timely or error-free.

To the maximum extent permitted by law, contXtual will not be liable for indirect, incidental, special, consequential or punitive damages, or for lost profits, revenue or data. Our total liability for all claims relating to the Service is limited to the amount you paid us in the twelve months before the claim, or USD 100 if you have not paid for the Service.

Nothing in these Terms limits liability that cannot be limited by law, such as liability for death or personal injury caused by negligence or for fraud.

We may update these Terms as the product evolves. If a change materially reduces your rights, we will notify you by email or through the Service at least 14 days before it takes effect. Continuing to use the Service after a change takes effect means you accept the updated Terms.
